Welcome to Makksquad (“we”, “us”, “our”, or the “Company”). These Terms and Conditions (“Terms”) govern your use of our website www.makksquad.com (the “Site”) and our services, including private label manufacturing and product sales.

By accessing or using our Site and services, you agree to comply with and be bound by these Terms. If you do not agree to these Terms, please do not use our Site.

 
1. Business Scope and Eligibility
Makksquad is primarily a B2B private label manufacturer of healthy snacks and related products.
Our services are intended for business clients, distributors, resellers, and brand owners. Individual direct-to-consumer sales may be selectively offered.
To engage with us as a business partner, you must be over 18 years of age and authorized to enter into contracts on behalf of your organization.

2. Product Information and Custom Orders
Product specifications, ingredients, packaging, pricing, and minimum order quantities are provided upon request or via personalized quotations.
Private label manufacturing includes branding, packaging customization, and product formulation as per mutually agreed specifications.
All product images and descriptions on the Site are for illustrative purposes; actual products may vary based on client requirements.

3. Ordering, Payment, and Fulfillment
Orders are confirmed only upon written agreement, proforma invoice, and receipt of advance payment (where applicable).
Payment methods may include bank transfer, cheque, or other accepted forms. Full payment terms will be shared in the quotation or invoice.
Delivery timelines and shipping terms are provided in the order contract and may vary based on customization, quantity, and location.
Title and risk in the products transfer to the client upon delivery to the requested address.

4. Intellectual Property
All intellectual property rights in the Site content, our trademarks, and proprietary products remain with Makksquad.
Private label products may contain your brand/trademark as per agreement, but the underlying product formulation and processes remain owned by Makksquad unless explicitly transferred.
You must not use our name, logo, or proprietary materials without written consent, except for authorized co-branding under contract.

5. Confidentiality
Both parties agree to keep confidential any proprietary information, trade secrets, or business information exchanged as part of private label engagement.
Confidentiality obligations survive completion or termination of the business relationship.

6. Cancellations and Refunds
Custom/private label orders are non-cancellable and non-refundable once production has commenced, except in mutually agreed exceptional circumstances.
For any claims regarding defective or non-compliant products, inform us in writing within 7 days of delivery. Our liability is limited to replacement or credit, as deemed appropriate.

7. Limitation of Liability
Makksquad is not liable for indirect, incidental, or consequential damages arising from use of our products or services.
Total liability, whether in contract or tort, will not exceed the total value of your order.
We do not guarantee uninterrupted website access or error-free operation.

8. Compliance and Indemnity
You are responsible for ensuring that your customized/private label products comply with applicable laws, labeling, and import/export requirements in your region.
You agree to indemnify Makksquad against any third-party claims resulting from misuse, misrepresentation, or non-compliance related to your private label products.

9. Website Use
You agree not to misuse the Site, introduce harmful code, or use automated systems to extract data.
Unauthorized use of the website, trademarks, or materials is strictly prohibited.

10. Governing Law and Jurisdiction
These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts of Uttar Pradesh.

11. Changes to Terms
We reserve the right to update or modify these Terms at any time. Changes become effective upon posting to this page. Continued use of the Site constitutes acceptance of revised Terms.
